Article 1 — Parties

Referred to in this agreement as "MIYC" or the "PROVIDER".
PARTICIPANT (CONSUMER)
The natural person who owns the name, surname, e-mail, telephone and other details given in the registration form. Referred to in this agreement as the "PARTICIPANT".
The details provided by the PARTICIPANT at registration form an inseparable part of this agreement and are deemed included in its text.
Article 2 — Subject
The subject of this agreement is the determination of the rights and obligations of the parties, in accordance with Consumer Protection Law No. 6502 and the Distance Contracts Regulation, in respect of the race, training or event service for which the PARTICIPANT has registered electronically through the miyc.org website and has paid the fee.
Article 3 — Service and Price
The name, scope, date, participant, reference number and total price including taxes of the service were displayed to the PARTICIPANT on the payment screen before payment and were approved by the PARTICIPANT.
The amount shown on the payment screen is the total price including taxes; no additional charges, commissions or service fees are applied.
Transport, accommodation, food and beverages, boat charter, insurance and personal equipment are not included unless expressly stated on the relevant race or course page.
Article 4 — Preliminary Information
The PARTICIPANT declares and accepts that, before this agreement was concluded, they read the Preliminary Information Form and were informed about the essential characteristics of the service, the identity and contact details of the PROVIDER, the total price including taxes, the payment and performance terms, the cases in which the right of withdrawal cannot be exercised, the cancellation and refund terms, and the channels for complaints and dispute resolution.
The PARTICIPANT was explicitly informed on the payment screen that their order creates a payment obligation.
Article 5 — Payment
Payment is made using the method selected by the PARTICIPANT from those offered on the payment screen.
Card payments are collected through the virtual POS infrastructure of Yapı ve Kredi Bankası A.Ş. with 3D Secure authentication. Card details are entered only on the bank's secure page; MIYC does not see, process or store them.
The agreement is deemed concluded upon approval of the payment by the bank. Payment confirmation is notified to the PARTICIPANT by e-mail together with the registration reference number.
For bank transfer or payment at the club, the agreement is concluded when the payment is recorded in MIYC's finance records.
Article 6 — Performance of the Service
The service is performed on the date and at the location announced for the relevant race, training or event.
For race registrations, performance is subject to the rules defined in the Notice of Race and Sailing Instructions of that race. The PARTICIPANT accepts that they have read these documents and will comply with the rules.
MIYC may postpone or cancel an event due to insufficient participation, adverse weather, safety concerns or force majeure. In such cases Section 4 of the Cancellation and Refund Policy applies.
Article 7 — Obligations of the Participant
The PARTICIPANT is responsible for:
- providing accurate and current information in the registration form,
- complying with the rules of the relevant race or course, safety instructions and the instructions of MIYC officials,
- in races, the suitability of their own boat, equipment and crew and the required insurance,
- ensuring that their state of health is suitable for participation.
Registrations on behalf of participants who are minors are made by a parent or legal guardian; the parent or legal guardian is deemed to have accepted this agreement on behalf of the participant.
Article 8 — Right of Withdrawal
The race, event and date-specific training services that are the subject of this agreement fall within Article 15, first paragraph, subparagraph (g) of the Distance Contracts Regulation, as services "relating to the use of leisure time for entertainment or recreation purposes that must be performed on a specific date or period". Accordingly, the PARTICIPANT has no right of withdrawal.
The PARTICIPANT was informed of this before payment through the Preliminary Information Form.
The absence of a right of withdrawal does not remove the PARTICIPANT's tiered cancellation and refund rights set out in the Cancellation and Refund Policy.
Article 9 — Cancellation and Refund
Cancellation and refund terms are set out in the Cancellation and Refund Policy, which forms an inseparable part of this agreement.
In summary: for race registrations, 100% refund 30+ days before, 50% refund 15–29 days before, no refund at 14 days or less; for events and training, 100% refund 14+ days before, 50% refund 7–13 days before, no refund under 7 days. No refund is made if the participant does not attend.
Refund requests are made in writing to miyc@miyc.org; approved refunds are made within 10 business days at the latest, using the original payment method, and for card payments only to the same card.
Article 10 — Protection of Personal Data
Information on the processing of personal data is set out in the Privacy Notice. The privacy notice is not submitted for the PARTICIPANT's approval; it is provided for information purposes.
Commercial electronic messages are sent solely on the basis of the separate and optional explicit consent given by the PARTICIPANT. Withholding this consent does not affect registration or payment; consent may be withdrawn at any time.
Article 11 — Force Majeure
Earthquake, fire, flood, war, epidemic, port closure, navigation bans, decisions of official authorities and similar events beyond the control of the parties are deemed force majeure.
In the event of force majeure, MIYC incurs no direct liability for failure to perform; Sections 4 and 5 of the Cancellation and Refund Policy apply.
Article 12 — Evidential Agreement
The parties accept that MIYC's system, server and database records, electronic approval records and bank transaction records shall constitute evidence in disputes arising from this agreement.
This provision does not remove the PARTICIPANT's right to submit counter-evidence.
Article 13 — Dispute Resolution
For disputes arising from this agreement, the Consumer Arbitration Committees at the PARTICIPANT's place of residence or at the place of the transaction have jurisdiction within the monetary limits determined annually by the Ministry of Trade, and the Consumer Courts for disputes above those limits.
Article 14 — Entry into Force
This agreement is concluded and enters into force electronically when the PARTICIPANT ticks the confirmation box on the payment screen and completes the payment.
The agreement is stored in MIYC's systems together with the date of approval and the version number; the PARTICIPANT may request a copy at miyc@miyc.org.
